How Does Foreclosure Work?
Going through a foreclosure is difficult for not only the homeowners but for the back as well. Very seldom do any parties come out winning after a foreclosure. Before discussing how foreclosures work, I’ll answer to why foreclosures happen to begin with.
For many people, owning a home is the biggest investment. Almost no one wants to ever lose their home, but it happens every day. The primary reason why most homes go into foreclosures may actually surprise you. Most people start considering foreclosure as an option when the value of their home is less than the amount owed on their mortgage. In the recent housing crisis we’ve seen the value of homes drop by as much as 50% or more in some markets. When the value of your home is worth more than your mortgage, your mortgage is “under water.” The other main reason is financial difficulties such as a sudden loss in revenues in the case of a job loss or major medical expense.
When you stop making payments on your mortgage, your lender will begin to contact you. Most lenders have programs in place to help people who are going through hard times; however, in a lot of cases, the homeowner may feel anxiety about communicating with the lenders. After several missed payments, your lender may start the pre-foreclosure process. They may contact you to advise you on a short sale. A short sale allows you the opportunity to try to sell your home prior to foreclosure in many cases less than the amount owed to the lender. Because foreclosure is a very expensive proposition, it’s in the best interest of the bank to work with you to find a resolution. If a short sale is not possible or the allocated time has passed, a bank will send you a foreclosure notice with a date you must vacate your home. Many banks will try to auction off the home first. If the auction fails, they often will hire a real estate agent to market and sell the property. Banks very rarely recover the full amount owed; however, foreclosure is typically the last resort.
